Taraba govt to release more funds for community development projects

After a verdict by the Taraba State high court sitting in Jalingo in favour of Ambassador Hassan Ardo Jika of a Land dispute of over 40 years between the Nigerian envoy to the Republic of Trinidad and Tobago and Sardauna Local Government Area (LGA)

The Chairman of the LGA,Hon Godwin Sol in an interview with Tgnews Stated that the council position to head for an appeal to seek for redress over the judgment he described was a decision of the state court not the true reflection of the facts on ground.

Is optimistic that the court appeal will counter a judgment in favour of the LGA and the entire people of Sardauna area

“The judgement is not in our favor, there is no point we are certainly going on an appeal because we believe we are going to have good judgment in the higher Court.” He said

Godwin further said that justice delay is never justice denial,as according to him they will never mind the longer time of the judgement may take by the upper court as long as there is going to be a favourable judgment

Another elder statesman of Sardauna LGA, Mr David Sufi berates the judgement of inconsequential and will not hesitate to appeal against it in an effort to seek for a better verdict in the higher court.

He said he they can be patience to wait for the case to linger all this while they are all the time ready to further wait for the appeal court Judgement.

You may wish to recall that an earlier verdict was passed Thursday at the Taraba state High Court holden in Jalingo in favour of Nigerian Envoy to the Republic of Trinidad and Tobago Alh Hassan Ardo Jika, in a land dispute that has lasted for over four decades, against Sardauna local government area, Mr Timothy Flias and eight others.

Justice Yusuf Bashir who delivered the judgement said that the defendants were not able to prove that they were the rightful owners of the land and that their actions amounts to criminal trespass and awarded the Plaintiff the sum of Two Hundred thousand Naira as damages.

The judgement read in part ” base on the evidence made available to this court, title is hereby declared in favour of the plaintiff and all other successors of the Late Ardo Hassan Hainare, over all the land in dispute.

” An order of perpetual injunction is hereby issued restraining the defendants, their privies and agents from further encroaching or trespassing on the land in dispute. A declaration that the action of the defendants amounts to trespass for sanction to the sum of two hundred thousand Naira awarded to the plaintiff as damage.

“The defendants are ordered to retrieve all trees planted by them on the land or forfeit them to the plaintiff”.

Meanwhile, the council to defendant Barr. Martins Milkman said that the judgement was ” an iron cast judgement that reflected very sound judicial prudence and tenacity that will stand the test of time and any challenges”.
