A High Court of the Federal Capital Territory (FCT) will deliver a ruling on September 5 in a suit seeking to stop the National Broadcasting Commission (NBC) from terminating a contract related to Nigeria’s transition from analogue to digital television.
Justice A.M. Ademu, a vacation judge, fixed the date to give a decision in the contract dispute after considering an ex-parte application brought by six companies involved in the disputed contractual agreement.
They sought to prohibit the NBC from exercising their contractual rights, advertising for bids for licenses, and granting licenses to other companies or individuals for the purpose of manufacturing Set Top Boxes until their case is fully disposed of
The companies, including Incorporated Trustees of the Association of Licensed Set Top Boxes Manufacturers of Nigeria, Gospell Digital Technology Ltd, and others, prayed for an order to restrain the NBC from interfering or terminating the contract pending the hearing of a motion on notice.
They sought to prohibit the NBC from exercising their contractual rights, advertising for bids for licenses, and granting licenses to other companies or individuals for the purpose of manufacturing Set Top Boxes until their case is fully disposed of.
The applicants claimed that the NBC initiated a policy of switching off analogue to digital torrential television in 2012 and granted them licenses to participate upon payment of N50M.
They alleged that the NBC Director General terminated their subsisting contract by announcing the adoption of Hybrid Android DTH Set Top Boxes with data connectivity functionalities

Justice Ademu fixed September 5 to deliver a ruling in the ex-parte application seeking a temporary order to stop the alleged unlawful act.
