The Federal High Court II sitting in Yola, Adamawa State on Friday, declined to nullify the primary election of the All Progressives Congress (APC) which produced Hon. Joseph Ayuba Kawada(Depolis) is the candidate for Michika/Madagali Federal constituency.
Hon. Justice S. I. Kogo refused to nullify the election while he delivered judgment in a suit instituted by an Aspirant, Anna Sini, who also contested for the seat in the just concluded primary election.
The judge declined to grant all the reliefs sought by the female politician and upheld the election, saying that the exercise conducted by APC for Michika/Madagali, complied with the provision of the law.
According to him, Hon. Depolis was duly screened and cleared by the Screening Committee of the party; hence, his participation in the exercise.
Anna had dragged Hon. Depolis and APC to court where she asked the court to nullify his election as his contest had violated the provision of the Constitution of the Federal Republic of Nigeria 1999, the electoral act, and the guidelines for the nomination of APC candidates.
She prayed for the court’s order declaring her as the duly elected Candidate of the APC for the constituency having secured the highest number of lawful votes during the exercise.
While reacting to the judgment, Counsel to Hon. Depolis, M. C. Chijoke, and that Plaintiff, Ever Odo, respectively, appreciated the court for the decision.
