….court orders immediate payments of N38,680m to Mathias and others
The immediate past Attorney General of the Adamawa State Government, Barrister Bala Sanga has dragged the present government under the leadership of Rt Hon Ahmadu Umaru Fintiri to the National Industrial Court in the Yola division held at Gombe before His Lordship HonJusticee J T Agbadu Fishim (Judge) for refusing to pay government appointees of the past regime their entitlement/ severance allowances.
Sanga on a case file Suit No NICN/YL/0M7/2024 on 19th Apri, 2024, counsel to Mathias Yohanna and others who are government Judgement creditors /applicants against Adamawa State government and Adamawa State attorney general (Judgment debtors/respondents) and Zenith Bank PLC, First Bank of Nigeria PLC, Fidelity Bank Plc, and United Bank of Africa (Garnishees).
Justice Agbadu ordered that the Garnishees account pay the sum of thirty-eight million, sixty hundred and eight thousand Naira (38,680.172) to Mathias and others.
Justice Agbadu in the judgment said the court as a result of clerical error inadvertently granted the order Nisi in the sum of twelve million, ninety-seven thousand two hundred and sixty-three nairas forty kobos only (12, 097,263.40) only leading to the shortfall of N26,582, 909.52 kobos.
He said the sum amount is ordinarily due from the Garnishees and is in the account of judgment debtors and many of its accounts in the name of any of the judgment debtors with the Garnishees.
The Honourable Judge also gave an interim order restraining the Garnishees by themselves, branches, privies, employees, howsoever named or described from allowing the judgment debtors/respondents or anybody from withdrawing, transferring, and or from any tempering with the supporting affidavit of Mathias Yohanna belonging to the judgment debtors.
