A case was mentioned today,Thursday,between Eric Theman and Independent national electoral commission (INEC) in Adamawa state High court No.3.
Counsel to the plaintiff, Mustapha Shaba Ibrahim filed a court case restraining the defendant (INEC),themselves, their executives, agents servants, representatives, nominees or any other person(s) from proceeding with the rescheduled or supplementary elections with respect to Adamawa state governorship, depending the hearing and the determination of the court.
The State chairman of movement for the Restoration and Defence of Democracy (MRDD),Ibrahim Umar Gonati through his counsel pray that the rescheduled election should be cancelled and conduct a fresh governorship election.
Umar in application submitted to the court supported by 37 paragraphs affidavit authenticating the eligibility of their candidate,who is contesting the governorship position but his party logo was not included or missing in the ballot paper.
The applicant also submitted supported with exhibit MRDD one to five is praying that the rescheduled election should not hold but a fresh election should be conducted where his party logo will be included.
The presiding judge, Justice Abdulaziz Waziri after perusing through all the applications of the plaintiff where is praying for the defendant, INEC to restrain from proceeding with the rescheduled supplementary election depending on the outcome of the court judgment said is of the view that the case will be given all the merit it deserve.
According to him considering the urgency of the motion expertae the case is adjourned to 21st March,2019 for further hearing for INEC to be served and respond duly.
Counsel to the plaintiff further Said that his client want an injunction where a fresh election with the logo of his properly printed in the ballot paper and is of the high hope on the case as the law is clearly stated about that.
