The Independent Electoral Commission (INEC) during the Tuesday Tribunal seating in Yola failed to present it’s witness before Hon.Justice A.A. Adebara the presiding Judge.
This coming after closing of All Progressives Congress,APC, witnesses testified against the Governorship election of 2019 to have been marred with many irregularities thereby Declared Rt Hon Ahmadu Umaru Fintiri as the executive governor of Adamawa state,the Court ordered that the respondents should open up their case immediately.
PDP, Ahmadu Umaru and INEC are three respondent expected to present 48 witnesses.
INEC affirmed that the documents tendered by the petitioner’s (APC) witnesses are truly it’s documents and it will be no use to present a defence or a counter witness(es) to that.
PDP is having 17 witnesses to presend at the Court, but at the seating on Monday after presenting one witness they close up their case- meaning they will not continue with the presentation of their witnesses.
Base on the provision of the electoral acts,the Court ordered that all respondent (INEC,PDP and Ahmadu Fintiri) should write their final writing address in the next 10 days,and APC having being served of the final writing address will reply the court within 7 days,after that APC will equally reply the respondents
The Court ordered that the respondent are having 5 days to reply the petitioner’s reply.
Have closed their case by calling 2 witnesses out of 48 witnesses respondent indicated in their respective replies. The matter is adjourned to 23-8-2019 for adoption of addresses and there after judgement.
