A judgment was passed Wednesday in favor of Barr Wali Yakubu, Mr. Saad Mai Yaki, and others in the National Industrial Court, Abuja by Honourable Justice E. N Agbakoba.
Wali had defeated Governor Ahmadu in a suitcase no. NICN/ABJ/252/2019 challenging their removal as appointees of former Governor Muhammadu Umaru Jibrilla Bindow
The Judgement held that Governor Ahmadu Umaru Fintiri Pay Yakubu Wali all salaries and allowances that would have accrued to him for five years.
You would recall that former Governor Mohammadu Umaru Jibrilla Bindow had appointed members of the Judicial Service Commission who are having the Constitutional mandate to serve for five years tenure, but on assumption into office, Governor Ahmadu Umaru Fintiri dissolved the Commission and appointed his nominees.
Former Attorney General of Governor Jibrilla, Barr Bala Sanga who is counsel to Yakubu Wali said the act contravened the act which established the Judiciary commission and Constitution of the federal Republic of Nigeria.
Sanga through his law firm, Lexfield Chambers when consulted approached the National industrial court which is of competent jurisdiction told our reporter in Abuja immediately after the judgment was passed that Yakubu and others who Ahmadu removed in office were illegally dissolved.
The matter was brought before Honourable Justice E. N Agbakoba and was yesterday (Wednesday) passed a verdict and ordered that Adamawa State Government pay Yakubu Wali all salaries, and allowances that would have accrued to him for five years he would have served, which if computed it will amount to over N40 million.
The court also ordered that Wali be paid the sum of N300,000.00 as damages incurred to him.
In a landmark judgment, the National Industrial Court held that Governor Fintiri had no powers to dissolve the Commission.
The court however rejected the claim for the cost of action.
