In a significant development in the ongoing legal battle between Alhaji Sadiq Wali and Umar Bello Jada, popularly known as ‘Calculate,’ the Adamawa State High Court has granted bail to Jada. The activist, a close associate of former Vice President Atiku Abubakar, had been detained following a defamation suit filed by Wali and his son, Adamu Wali.
The initial arrest and detention of Jada sparked controversy. The Chief Magistrate Court II, presided over by Magistrate Musa Alhaji, had imposed stringent bail conditions, requiring a first-class traditional ruler as surety and a ₦5 million bond. These conditions effectively prevented Jada’s release.
However, Jada’s legal team challenged the magistrate court’s decision, arguing procedural irregularities. They successfully secured an ex-parte motion for judicial review before the Adamawa State High Court, presided over by Justice Ahmed Isa.
Justice Isa granted Jada bail on significantly more lenient terms: a ₦1 million bond and a surety residing in Yola
Justice Isa found merit in Jada’s appeal, criticizing the magistrate court for procedural violations, including improper service of summons and warrants, and denying Jada sufficient time to prepare a defense. The judge also noted the absence of the complainants, Sadiq and Adamu Wali, during the proceedings in the lower court, deeming this a jurisdictional issue.
Consequently, Justice Isa granted Jada bail on significantly more lenient terms: a ₦1 million bond and a surety residing in Yola. He further ordered the magistrate court to halt proceedings until the High Court rules on the substantive motion. The ruling has been celebrated by Jada’s legal team as a victory for the rule of law.
The case has attracted significant public attention, raising concerns about judicial conduct and due process, particularly regarding the jurisdiction of magistrate courts in defamation cases. The courtroom was filled with prominent figures, including Senator Ishaku Abbo and Alhaji Bamanga Yahaya, highlighting the case’s political significance.
