Appeal court Judge, Hon. Justice H. A. Abiru today in Yola have reserved the Judgment before him to a later date between the Adamawa State House of Assembly Speaker, Rt Hon Aminu Iya Abbas and Ibrahim Mustapha.
You would recalled that the Speaker’s ticket was invalidated by the trial court on grounds of the participation of Auwal D. Tukur, in the race.
Auwal Tukur, participated in the exercise without resigning his appointment as the Chairman Governing Council of the State University(ADSU) Mubi.
On this ground speaker Aminu Iya Abbas’ ticket was nullified, he urged the Court of Appeal Yola Division to allow his appeal and set aside the judgement of the Federal High Court.
The Speaker whose ticket for Adamawa Central District was voided by the Federal High Court presided by A. M. Anka, asked the appeal court to upturn the trial court’s verdict.
Rt. Hon. Iya Abbas, prayed the appellate court to allow his appeal, nullify the judgement and restore him as the nominated and duly elected Candidate of the PDP for central district.
Equally, he urged the court to strike out the originating summons filed before the trial court by the 2nd respondent in the appeal, Hon. Ibrahim Mustapha.
Rt. Hon. Iya Abbas, through his counsel, Mahmud Abubakar Magaji, drew the attention of the appellate court on 8 issues distilled for determination, and however adopted all arguments.
On his part, Counsel to the 1st respondent, Abdulhamid Mohammed, adopted all his arguments filed and prayed the court to dismiss the appeal with a substantial cost.
Other appeals filed by the aggrieved PDP Aspirants for the central zone include; Auwal D. Tukur verses Ibrahim Mustapha and 3 others, Ibrahim Mustapha verses PDP and 3 others.
The Speaker has joined Ibrahim Mustapha, PDP, Independent National Electoral Commission(INEC) and Auwal D. Tukur as 1st, 2nd, 3rd and 4th respondents in the appeal.
Meanwhile, in his appeal, the embattled aspirant, Auwal D. Tukur, through his counsel, Eyitayo Jegede, appealed to the court to allow his appeal, vacate orders made by lower court.
