US Supreme Court Temporarily Restores Mail Delivery of Abortion Pill Mifepristone

The United States Supreme Court on Monday issued a temporary stay, restoring nationwide mail delivery of the widely used abortion medication mifepristone until at least May 11.

The move comes after a three-judge panel of the conservative-dominated 5th Circuit Court of Appeals halted mail-order access to the drug on Friday, in response to a lawsuit filed by the state of Louisiana against the Food and Drug Administration (FDA).

Mifepristone, approved by the FDA since 2000 and used in the majority of abortions in the US, is typically combined with misoprostol to terminate pregnancies up to 70 days of gestation. It is also commonly prescribed for managing early miscarriages.

Danco Laboratories and GenBioPro, the manufacturers of mifepristone, urgently appealed to the Supreme Court for a one-week pause on the appeals court ruling to allow time for a full emergency challenge.

In a brief order issued without explanation, the Supreme Court agreed to temporarily block the 5th Circuit’s decision. The ruling would have required women seeking the medication to obtain it in person from clinics and banned delivery by mail or through pharmacies via telemedicine.

Reacting to the development, Julia Kaye of the American Civil Liberties Union described the Supreme Court’s intervention as a “positive short-term development,” while cautioning that access remains precarious.

Nancy Northup, President and CEO of the Centre for Reproductive Rights, emphasised the importance of telehealth access. “Obtaining abortion pills through telehealth has been a lifeline for women. There is no reason people shouldn’t be able to get mifepristone at a pharmacy or through the mail,” she said.

The Alliance Defending Freedom (ADF), which supports the anti-abortion challenge, clarified that the Supreme Court’s action was not a reversal but a temporary pause. The group vowed to continue its legal fight to uphold restrictions on mail-order distribution of the drug.

The latest twist is part of ongoing legal battles over abortion access following the Supreme Court’s 2022 decision to overturn Roe v. Wade, which has led to bans or severe restrictions in more than 20 states.

Polls consistently show that a majority of Americans support maintaining access to safe and legal abortion services, even as conservative groups push for tighter controls.

This case will continue to be closely watched as parties file legal briefs ahead of further Supreme Court consideration.
